Résumé :
|
This special issue of the Scandinavian Journal of Disability Research addresses justice and the rule of law with regard to the situation for persons with disabilities. The intersection between these two thematic fields has been made topical in the Nordic countries in the implementation process for the UN Convention on the Rights of Persons with Disabilities, as well as the aftermath of two well-documented examples of serious miscarriages of justice in criminal cases where people with disabilities were falsely convicted. The five articles in this volume discuss different aspects of how the criminal justice system is applied in cases involving persons with disabilities. One of the articles outlines a theoretical background and provides an overview of relevant research, and four articles discuss findings from recent empirical studies of cases where pivotal safeguarding principles are at stake. The articles have been produced with grants from the Fritz Moen Research Fund. (From the abstract)
